  2. Why do we collect and use your personal data?

    1. We collect and use your personal information to provide you with vehicle finance via our application form and, potentially, from third parties to whom you have applied.
    2. We act as a data controller.
    3. The lawful basis on which we use your information depends on the activity:
      1. Finance applications: we rely on consent and contractual necessity.
      2. Direct marketing about products and services relating to your car finance agreement: we rely on Legitimate Interests, including the “soft opt-in” exemption under PECR 2003. You can opt out at any time.
      3. Direct marketing about other consumer redress or legal claims (not directly connected to your car finance agreement): we will only contact you where you have given us your consent to do so.
      4. Sharing with Legal Services Today (LST): this will occur only if you decide to pursue a claim or redress opportunity with LST. At that point, LST becomes an independent controller of your data under its own privacy policy.
    4. We obtain your information when you agree to our terms of business and privacy policy when making an application.
    5. We may also share your personal information with carefully selected third parties whose products or services we believe may be of genuine interest or benefit to you. These third parties may contact you directly. We will only do this where you have provided your consent, and you will always have the right to opt out of such communications at any time.
    6. If you do not want us to use your information, please do not submit an application to us.
    7. You can withdraw your consent at any time using the contact details listed above.
    8. We will not use your data for any other purposes without informing you and obtaining your consent where required.

      1. Identity Data includes title, first name, last name, marital status, date of birth, residential status, address, time at address, and driving licence details.
      2. Employment Data includes current employment status, time in current employment, occupation, payslips, employer name, and net monthly income.
      3. Vehicle Data includes your current vehicle, car registration, registered address, and car tax number.
      4. Transaction Data includes details of products and services you have engaged from us.
      5. Contact Data includes email address and telephone numbers.
      6. Financial Data includes bank statements and payment card details.
      7. Profile Data includes services engaged, your interests, preferences, and feedback.
      8. Technical Data includes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
      9. Usage Data includes information about how you use our website and services.
      10. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
    10. We will never request sensitive information, or information that we do not require. However, if you provide us with data that is classed as a special category of data (such as health information, criminal records of convictions and offences, or allegations of criminal offences), we will only process this with your permission (unless we consider the processing necessary to protect your vital interests or if the law allows us to do so).

  3. What happens if I do not provide my personal information?

    1. We need your personal information to process your request or finance application. If we do not collect your personal information, we will not be able to provide our services to you.
    2. We may use your personal information to send you marketing communications by email or SMS in the following ways:
      • Car finance and related services – We may send you information about products and services connected to your car finance agreement, including regulatory or legal developments (for example, potential claims for undisclosed commission). We rely on our Legitimate Interests, including the soft opt-in exemption under PECR 2003, to do this. You can opt out of these communications at any time by clicking the unsubscribe link in any message or contacting us directly.
      • Other consumer redress or legal claims – For marketing about other types of legal claims or consumer redress opportunities not directly related to your car finance agreement, we will only contact you where you have given us yourexplicit consent to do so. You can withdraw this consent at any time.
    3. We will not send you marketing communications from third parties without your consent.
    4. You have the right to object to receiving marketing communications at any time, and we will always provide you with an easy way to unsubscribe.
  4. Who will we share your personal information with?

    1. We will share your information with the lenders with whom we work in order to assist you in gaining an acceptance. These include the below:
    2. We may also share your information with our partner law firm, Legal Services Today Limited (SRA number 643776), if you decide to pursue a legal claim or redress opportunity. This may include, but is not limited to, claims connected to your car finance agreement. We will only pass your details to LST if you have chosen to instruct them, and once LST receives your data, they will become an independent controller and will process your data in line with their own privacy notice.
    3. Your information will be held on our CRM system, AutoConvert (Blue Owl Network Ltd). You can view their privacy policy here:https://www.autoconvert.co.uk/privacy-policy/. AutoConvert may check records about you with their chosen credit reference agencies (CRAs), Equifax Ltd andExperian Ltd, for purposes such as assessing applications for credit and verifying identities to prevent and detect crime.
    4. When Equifax and/or Experian receives a search request from us via AutoConvert, they will place a soft quotation footprint that will be visible to you only on your credit file; other parties, including lenders, will not see this. This will not affect your credit score/rating or ability to apply for finance from other lenders (please note that when lenders conduct searches with CRAs, it may leave a footprint). AutoConvert will access from Equifax Ltd and/or Experian Ltd both public (including the electoral register) and shared credit and fraud prevention information. This information will be used to check your eligibility against a select group of lenders.
    5. We will not see your full credit file; AutoConvert will only provide a list of lenders that you are likely to be accepted for given the information supplied, using their brokering technology that understands the acceptance criteria of the lenders on their panel.
    6. If you give us false or inaccurate information and we suspect or identify fraud, we will record this and may also pass this information to fraud prevention agencies (FPAs) and other organisations involved in crime and fraud prevention.

    9. The personal information we have collected from you will be shared with fraud prevention agencies who will use it to prevent fraud and money-laundering and to verify your identity. If fraud is detected, you could be refused certain services, finance or employment. Further details of how your information will be used by our finance partners and these fraud prevention agencies can be found in the above privacy links.
    10. To complete your finance agreement, we may require some information from the supplying dealership. To raise the necessary paperwork, we may need to send them your name, address and contact number. We may also liaise with them regarding any future aftersales issues where required.
    11. If required, we will also share your information with third parties for accounting, legal or regulatory purposes (such as, but not limited to, HMRC, FCA, etc.).
    12. Please note, as a company we do not share your data outside of the UK/EEA. We ask you to ensure you are aware of how the above companies share and use your data, so you are fully informed.
    13. We complete due diligence on any third party with whom we work to ensure they comply with GDPR and are happy to provide further information or answer any questions you may have.
  5. How long will we store your personal information?

    1. We will store your personal information for up to six years on our CRM systems. We are committed to ensuring your data is kept secure and we review our security systems on a regular basis.
    2. This is to enable us to refer to our records should we be required to do so for regulatory or legal reasons.
    3. If you do not object to receiving marketing communications from us, we will store your personal information for marketing purposes until you unsubscribe from receiving marketing communications from us.
    4. Please note that some of your information may be included in information used for accounting purposes. Where this is the case, this information is kept for seven years as per our legal requirements.
    5. Once this time period has ended, your information will be confidentially destroyed and removed from all systems and records.
